The current Circle C Declaration of Covenants, Conditions, and Restrictions (CC&Rs) were written in 1988 and does not address short-term rentals (STRs) within Circle C.

Over the last year, many residents have raised concerns with the Board of Directors regarding the presence and lack of oversight of STRs in Circle C.  In the Spring, the Board of Directors hosted a productive Town Hall to hear from residents directly on the issue.  A wide range of residents with diverse thoughts and feedback participated.  Following the Town Hall, the Board of Directors voted to proceed with the community-wide vote to determine whether an official amendment to the CC&Rs was needed, prohibiting STRs in the neighborhood.

The proposed amendment (Article V, Section 10 to the CC&Rs) would provide a clear definition of what it means to lease one’s home, as well as addressing the conditions to a lease.  The conditions include acknowledgment by the owner to adhere to the Circle C HOA governing documents when leasing which includes minimum lease term of six months, limitations to subleasing after a cancellation, and penalties and fines for violation the terms outlined in the CC&Rs.

To Amend the CC&Rs, 66 2/3 of all properties (approximately 3,750 of the 5,622 properties in Circle C will need to vote in favor of the proposed amendment.  Each property is allowed one vote.
